This Terms of Use and Terms and Conditions Agreement (“Agreement”) constitutes a legally binding contract between National Safety Institute LLC (“National Safety Institute,” “NSI,” “Organization,” “we,” “us,” or “our”) and any individual or entity (“User,” “Learner,” or “Participant”) who accesses, browses, registers for, enrolls in, purchases, or otherwise uses our website, online learning systems, digital content, assessment platforms, customer portals, and related services (collectively, the “Services”).
By accessing or using the Services, the User expressly acknowledges that they have read, understood, and agree to be bound by this Agreement and all incorporated policies, including but not limited to the Privacy Policy and the Refund Policy.
If the User does not agree to this Agreement, the User must immediately discontinue use of the Services.
National Safety Institute reserves the right, at its sole discretion, to modify, amend, or update this Agreement at any time without prior notice. Any such modifications become effective immediately upon posting to the website. Continued use of the Services after such posting constitutes acceptance of the modified terms.

If a course license is purchased for another individual, including a minor, the purchaser assumes responsibility for ensuring compliance with this Agreement by the end user.
National Safety Institute reserves the right to deny enrollment or revoke participation where eligibility requirements are not met or where misconduct has occurred.
Certain Services require account registration. During registration, the User must affirmatively accept this Agreement by selecting a confirmation mechanism (e.g., clicking “Register,” “Login,” or similar acknowledgment).

Each purchased course license grants access to one individual only and may not be transferred or shared.
The Organization reserves the right to suspend or terminate accounts in cases of policy violations, fraud, misuse, security threats, or misconduct.
National Safety Institute provides professional development, continuing education, compliance training, safety training, certification, and recertification programs delivered via online platforms.
Participation may require:
Failure to complete required components may result in denial of certificate issuance.
Certain courses may require redirection to third-party platforms. In such cases, Users must review and accept the applicable third-party terms and privacy policies. National Safety Institute is not responsible for third-party operations.
Subject to compliance with this Agreement and payment of applicable fees, National Safety Institute grants a limited, non-exclusive, non-transferable, revocable license to access course materials solely for personal, non-commercial educational use.

All materials are protected by copyright, trademark, and intellectual property laws. Unauthorized use may result in legal action and immediate termination of access.
The integrity of assessments is fundamental. The following actions constitute misconduct:
If misconduct is identified, the Organization may:
Certificates are non-transferable and may be invalidated if issued in error or obtained through misconduct.
All program fees are published on the website and must be paid prior to course access.
Refund requests must be submitted in writing via email or through the user portal.
A full refund may be granted if requested within seven (7) calendar days of purchase, provided no course content or assessments have been accessed.
Partial refunds may be granted if content has been accessed, subject to internal review.
No refunds shall be issued once an assessment has commenced or a certificate has been issued.
Approved refunds are processed within ten (10) to fourteen (14) business days and returned to the original payment method unless otherwise required by law.
The Organization may cancel enrollment in cases of fraud, policy violations, or system misuse.
National Safety Institute maintains a documented and impartial complaints handling process.

All complaints shall be acknowledged within three (3) business days of receipt.
Complaints are reviewed by an impartial staff member not involved in the subject matter of the complaint.
The investigator may request additional documentation or clarification from relevant parties.
Investigations are completed within thirty (30) business days whenever feasible.
All complaints are documented and securely retained according to record retention requirements.
Confidentiality is maintained to the extent permitted by law.

The Organization does not guarantee uninterrupted access, error-free assessments, passing examination outcomes, or employment results.
To the fullest extent permitted by law, National Safety Institute shall not be liable for indirect, incidental, consequential, or special damages arising from use of the Services.
Participation in the Services is undertaken at the User’s own risk.
This Agreement shall be governed by the laws of the State of Texas.
All disputes shall be resolved through binding individual arbitration under the Federal Arbitration Act before the American Arbitration Association.
The parties waive any right to trial by jury and agree that no class or representative actions shall be permitted.
If any provision is found unenforceable, remaining provisions shall remain valid.
The Organization may assign this Agreement in connection with merger, acquisition, or restructuring.
This Agreement and incorporated policies constitute the entire agreement between the User and National Safety Institute regarding the Services.
